Will the Gallatin County Sheriff’s Office protect the Safety and Constitutional Rights of everyone in Gallatin County?
This is not a theoretical question. This is a pressing concern for many of us. Federal agents, i.e., ICE agents, have come into our Gallatin County community and violated the Constitutional Rights of our residents.
Sworn Officers of the Gallatin County Sheriff’s Office have taken an oath to the Constitution of the United States and the State of Montana.
Excerpt from the Gallatin County Sheriff’s Office Policy Manual:
“I (state your name) do solemnly swear that I will support, protect and defend the Constitution of the United States, and the Constitution of the State of Montana, and that I will discharge the duties of my office with fidelity so help me God.”
Sworn Officers of the Gallatin County Sheriff’s Office are bound by their Code of Ethics to protect the Constitutional Rights of ALL.
Excerpt from the Gallatin County Sheriff’s Office Policy Manual:
“My fundamental responsibility as a public safety officer is to serve the community, safeguard lives and property, protect the innocent, keep the peace, and ensure the constitutional rights of all are not abridged;”
Sworn Officers of the Gallatin County Sheriff’s Office are policy bound to a duty to intercede and report unreasonable force from any law enforcement officer.
Excerpt from the Gallatin County Sheriff’s Office Policy Manual:
“300.2.1 DUTY TO INTERCEDE AND REPORT
Any deputy present and observing another law enforcement officer or a member using force that is clearly beyond that which is objectively reasonable under the circumstances shall, when in a position to do so, intercede to prevent the use of unreasonable force.
Any deputy who observes another law enforcement officer or a member use force that is potentially beyond that which is objectively reasonable under the circumstances should report these observations to a supervisor as soon as feasible.”
When ICE came in force to Gallatin County in late June 2026 – early July 2026, our law enforcement did not meet the needs of our residents. Communities were terrorized. Law enforcement is supposed to be the organization you go to for help; not the source of fear. José David Cortez Torres was arrested by ICE in Gallatin County and later freed when a Federal Judge ruled his constitutional rights had been violated. When a citizen had a weapon pointed at her by an ICE agent near a school, she called 911. No officer came to her aid or even proactively took a statement. If an ICE agent wasn’t involved, a person aiming a weapon and running towards a school would have elicited a much different response from law enforcement.
Under the leadership of J. Garrett Grimm Deputies of the Gallatin County Sheriff’s Office will follow their Oath, Ethics, and Policy to protect ALL residents of Gallatin County. The Sheriff’s Office would respond to calls, protect rights, address crimes, and document the actions of ICE agents.
